1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FZ Trade OÜ ("Company", "we", "us", or "our") concerning your access to and use of the FZ Customizer platform and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By creating an account, you represent that you meet these requirements.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

3.1 Subscription Plans

FZ Customizer offers various subscription plans with different features and usage limits. Current plan details are available on our pricing page.

3.2 Billing

• Subscriptions are billed monthly or annually in advance
• Payment is processed through Stripe, our secure payment processor
• You authorize us to charge your payment method for all applicable fees
• Prices are subject to change with 30 days notice

3.3 Free Trial

New users receive a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial without charge.

3.4 Refunds

We offer a 14-day money-back guarantee from the date of your first payment (excluding trial period). Refund requests must be submitted to support@fzcustomizer.com.

3.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

4. Usage Limits and Fair Use

4.1 Usage Quotas

Each subscription plan includes specific usage limits for AI generations, storage, and other features. You agree to use the Service within these limits.

4.2 Fair Use Policy

You agree not to:

• Abuse or excessively use AI generation features
• Use automated systems to exceed usage limits
• Resell or redistribute Service features to third parties
• Use the Service for illegal or unauthorized purposes

5. Intellectual Property

5.1 Your Content

You retain all rights to content you upload or create using the Service ("Your Content"). By using the Service, you grant us a license to store, process, and display Your Content solely to provide the Service.

5.2 Our Intellectual Property

The Service, including its software, design, and content, is owned by FZ Trade OÜ and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

5.3 AI-Generated Content

Content generated using our AI features belongs to you. However, you are responsible for ensuring your use of AI-generated content complies with applicable laws and does not infringe third-party rights.

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service to harass, abuse, or harm others
• Create content that is illegal, obscene, or offensive
• Impersonate any person or entity
• Collect user data without consent
• Use the Service for spam or unsolicited marketing

7. Termination

7.1 By You

You may terminate your account at any time by contacting support or through account settings.

7.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay applicable fees
• Engage in fraudulent or illegal activities
• Abuse the Service or harm other users

7.3 Effect of Termination

Upon termination, your access to the Service will cease immediately. We will delete your data within 30 days unless retention is required by law.

8.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.2 Limitation of Liability

To the maximum extent permitted by law, FZ Trade OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

8.3 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a prominent notice on the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FZ Trade OÜ regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
